Arbitration is an alternative dispute resolution (ADR) process (meaning non-court process) that seeks to facilitate the fair and speedy resolution of disputes without unnecessary expense. It is a popular mechanism, in particular for the commercial sector because of its efficiency and confidentiality. The framework and arbitration in Hong Kong is mainly governed by the Arbitration Ordinance (Cap. 609) and the Hong Kong International Arbitration Center (HKIAC) also plays a crucial role in administering arbitration cases in Hong Kong.

Civil Fraud / Asset Recovery

"Civil Fraud/Asset Recovery" involves legal actions aimed at identifying, recovering, and compensating for losses caused by fraudulent activities. Once fraud is established, the focus shifts to tracing and recovering assets that were obtained through fraudulent means. This may involve uncovering hidden assets, such as bank accounts or properties. Such recovery process would typically require the expertise of forensic accounting or working with different kinds of financial institutions.

Company Law

Company law covers a wide range of actions concerning companies in Hong Kong. It includes the incorporation, management (such as shareholder rights, directors’ duties) and dissolution of companies. The two crucial legislations in this area of law are the Companies Ordinance (Cap. 622) and Companies (Winding Up and Miscellaneous Provisions) Ordinance (Cap. 32).

General Civil Litigation

General Civil Litigation is a broad discipline of private laws. It deals with and resolves non-criminal disputes between individuals, organizations or businesses. Civil Litigation is a difficult subject and such process is often a lengthy and complicated one which is common that a civil litigation could take a number of years which focuses also on procedural matters in addition to the substantive claims of parties.

White Collar Crime

White collar crime is a type of complex crime that addresses non-violent crimes committed for financial gain. It is often committed by individuals in professional or higher positions. Some typical white collar crime are money laundering, insider trading and bribery. Unlike general crime, the law enforcement agencies for white collar crime are mainly the Independent Commission Against Corruption (ICAC) and the Securities and Future Commission (SFC).

Injunction Relief / Contempt

Injunction relief is a draconian common law product which compels or restrains a mandatory and prohibitory action to preserve the status quo. One of the most common types of injunction in the field of commercial law is a Mareva Injunction which operates as a freezing order of assets to restrain a Defendant from disposing or dissipating his or her assets before the conclusion of trial. Contempt proceedings is also uncommon in commercial law which concerns with actions disobeying or breaching court orders or proceedings. This type of actions is serious which might result in immediate imprisonment.

Mental Health

Mental health law is a novel area in Hong Kong which is in recently developing and resolving that reflects the aging problem within the territory. It is in place to provide protection and treatment to Mentally Incapacitated Persons (MIP) to their health beings and wealth. Typical court applications include guardianship orders, as well as management of property and affairs for the mentally incapacitated individuals. This area of law is primarily governed by the Mental Health Ordinance (Cap.136).

Family Law

Family law is a branch of civil law that deals with domestic issues involves, usually, breakdown of relationships, either in the marriage or not.
