Sabrina Leung, instructed by Gloria Chan & Co, acted for the Plaintiff who was involved in a motorcycle accident and thereafter sought damages for injuries and loss by filing a personal injury claim against the Defendant.
In challenging the Plaintiff’s claim, the Defendant served interrogatories without order asking, amongst the others, about the Plaintiff’s employment details. The Plaintiff successfully resisted the application before a Master, which led to the subsequent appeal by the Defendant.
After hearing the appeal, the Honourable Mr Justice Leung found that the interrogatories were indeed unnecessary for the fair disposal of the dispute or for saving costs due to it being geared towards exploring the Plaintiff’s credibility only. The Court therefore upheld Master’s decision by ruling in favour of the Plaintiff and dismissed the Defendant’s appeal.
